Role and Responsibilities

The Senior Legal Counsel will provide legal counseling and investigation support to all Samsung Electronics America (SEA) and North America Headquarters (NAHQ) divisions on areas of employment and labor law compliance, including equal opportunity laws, leave and accommodation laws, wage and hour laws, pay equity, labor law, benefits law, and internal policy development and training.  This position will also handle threatened litigation and negotiation with opposing counsel; agency administrative charges of discrimination; and supervision of litigation and arbitrations.

Responsibilities:

  • Investigate, respond to and mediate agency matters (EEOC, state divisions of civil rights, Department of Labor). Investigate, respond to and negotiate pre-litigation claims.  Handle employee litigation and arbitrations.       
  • Review and update employee handbook and policies for SEA and subsidiaries/affiliates. 
  • Review and revise executive offer letters, agreements and incentive plans.
  • Review and revise commercial contracts to address employment law matters. 
  • Oversee investigations of employee complaints. 
  • Provide counseling to Human Resources and subsidiaries/affiliates on employee performance improvement, discipline and terminations. 
  • Provide counseling regarding wage and hour exemptions and compliance with FLSA and comparable state and local laws. 
  • Provide counseling regarding employee accommodations and obligations under disability laws. 
  • Provide counseling regarding FMLA compliance, leaves of absence and paid sick leave. 
  • Provide counseling on pay equity laws and reviews.
  • Provide counseling on employment law issues and reporting obligations for purposes of compliance and audit.
  • Prepare and conduct training for Human Resources and other internal clients on employment law trends and issues and best practices for mitigating legal risk.

Skills and Qualifications

Required skills

  • Juris Doctorate degree from accredited US Law School with 3-6 years of experience.
  • Member in good standing of one US state bar, and ability to become member in good standing of NJ or TX bar or qualify as in-house counsel in NJ or TX.
  • Must have excellent written and verbal communication skills.
  • Experience appearing before state and federal agencies on employment matters. 
  • Experience counseling employers on an array of employment and labor related matters. 
  • Demonstrated effectiveness with multiple stakeholders and diverse constituencies.                
  • Team player with the ability to proactively collaborate with cross-functional teams.  
  • Executive presence combined with strong interpersonal and organizational skills and a demonstrated ability to proactively provide sound legal support and exercise good judgment in a dynamic and fast-paced environment. 
  • Intellectual curiosity and business awareness and desire to develop a deep understanding of the business environment in which he/she operates.

Preferred skills:

  • Training and presentation skills.
  • Experience conducting wage and hour audits; pay equity audits and reviews; and/or handling matters involving OFCCP compliance.
  • Knowledge of reviewing and analyzing post-termination contractual obligations (non-competition, non-solicitation and confidentiality obligations).
  • Benefits law experience.
  • Drafting experience related to executive offer letters and agreements.
  • Familiarity with handling immigration matters.

The salary range for this role is expected to be between $190,000 and $200,000.  Actual pay will be determined considering factors such as relevant skills and experience, and comparison to other employees in the role.
