Job Summary: THIS IS AN DISTRICT OF COLUMBIA NATIONAL GUARD TITLE 5 EXCEPTED SERVICE POSITION This position is in the Excepted Service under the authority of Title V, P.L. 114-328, Sections 932 and 1084 (FY17 NDAA) This position is part of the District of Columbia National Guard under Position Description Number NGT0097000. -- This is NOT a REMOTE position; the incumbent will report to a Duty Station --

Major Duties:

  • The position is located in the Joint Force Headquarters - State (JFHQ-ST), Office of the Staff Judge Advocate (SJA) or the wing staff Office of the Judge Advocate (SJA ). The primary purpose of the position is to serve as the full-time professional legal adviser and support to the Adjutant General, the Commander of federally recognized Army and Air National Guards, and state/territory unique public defense or safety structures or wing commander . In this primary purpose, this position also serves as the full-time professional legal advisor and support to Sexual Assault Response Coordinator and State Equal Employment Opportunity advisors, and subordinate commanders to support the state prevention efforts relating to sexual assault, sexual harassment, and domestic abuse . This position also serves as a professional legal adviser to the United States Property and Fiscal Officer (USPFO), state/territory National Guard senior leadership, state/territory National Guard directorates, and subordinate National Guard commanded units or state/territory level divisions. Duties Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; and a full spectrum of expert legal advice. Responsible to advise on the legal, factual, and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted, sensitive and emotionally charged issues relating to sexual crimes, harassment, domestic violence/abuse, and to the prevention and response of sexual crimes, harassment, and domestic violence/abuse. Serves as the state/territory National Guard litigation point of contact. Represents the state/territory National Guard in all legal matters in state/territory of original or appellate jurisdictions, to include matters pertaining to sexual crimes, sexual harassment, and domestic violence/abuse. Advises Army National Guard (ARNG) and Air National Guard (ANG) contracting officers, reviews contracts, procurement actions and real property matters involving Federal and state/territory funds (some involving substantial amounts of money) for legal sufficiency, appropriate titling and claim initiation or resolution actions. Possesses a thorough understanding of controlling labor laws, regulations, labor arbitration, collective bargaining agreements and pertinent labor relations practices. Reviews collective bargaining agreements for legal sufficiency. Note: This is not a comprehensive list of duties and responsibilities for this PD Number T0097000 as released in FASCLASS.

Qualifications: Area of Consideration Group 3- All groups of Federal re-employable eligibles. GENERAL EXPERIENCE is a minimum of two (2) years of professional legal experience following bar admission. SPECIALIZED EXPERIENCE - Must have at least one (1) year of specialized experience equivalent to the GS-12 level in the federal service. Specialized experience is defined as professional legal experience that involves: Independent Analysis: Performing complex legal research and analysis on high-stakes or sensitive issues with minimal supervision. Advisory Functions: Providing authoritative legal advice and guidance to management or senior officials regarding statutes, regulations, and policies. Document Drafting: Drafting or reviewing complex legal documents, such as litigation briefs, formal legal opinions, or proposed legislation/regulations. Representation: Representing the agency's interests in negotiations, administrative hearings, or meetings with outside counsel and stakeholders.
