Job Description
We are seeking a Senior Counsel (Associate Director Legal & Compliance) to join the Legal team within the Spanish & Portuguese affiliate. The position is based either in Madrid or in Lisbon (in which case, regular travel to Madrid (approximately every two weeks for two days) will be required). The successful candidate must be a fully qualified lawyer admitted to practice in Portugal, with strong expertise in Portuguese law and fluency in Portuguese, Spanish, and English.
The role reports to the Head of Lead and Compliance (Associate General Counsel / Senior Director Legal & Compliance) and is part of a team managing a high volume of legal and compliance support on a range of issues often with tight deadlines. It will require a responsive and self-driven, hands-on mentality and approach. The team also is composed by two legal Directors and one compliance specialist to manage our healthcare compliance programs, including process development, compliance monitoring and transparency obligations.
Job duties
As a key member of the Spain and Portugal Legal & Compliance team, you will ensure seamless collaboration between Portugal and Spain, supporting internal clients and cross functional teams. If based in Lisbon, this includes regular travel to Madrid to attend key meetings and coordinate cross-functional projects.
You will give substantive legal advice to one or more of Gilead’s Business Units and cross functional teams supporting the activities of the Business Units on sales and marketing strategies, medical educational activities, public affairs, patient group and community activities as well as policy and government affairs initiatives. As such, this job requires an analytical approach, strong attention to detail, excellent drafting, negotiation and communication skills.
This role also has a focus on leading the compliance program in Portugal, providing tools and guidance to the Business Units about Gilead’s Business Conduct Manual, the Apifarma Code of Practice, competition and consumer law, and antibribery. The role requires advising on Portuguese legal topics. In addition, you will have the opportunity to work with the regional and global Legal teams to develop Gilead wide responses to areas of wider legal and compliance importance.
Legal Responsibilities:
. Lead on strategic legal advice on Portuguese law and operational support for one or more of Gilead Business Units and
other functions in the Spanish & Portuguese affiliate in relation to:
• Identify and spot all legal and business issues in Gilead’s day-to-day activities.
• Appropriately analyze the issues, becoming the go-to person and effectively contributing to legal and cross
functional projects.
• Assist the business unit in the planning and implementation of product promotion and launch, including supporting
market access strategy.
• Lead in your legal areas of specialisation as well as in new areas as required by the team.
• Negotiate, draft and review all kind of agreements, as required by the Business Units, including drafting templates
and keeping up to date the contacting template platform.
• Be or become an expert in the pharma regulation, including particularities of reimbursement of medicines.
• Together with global specialist support teams, advise on competition law and anti-bribery anti-corruption
processes.
• Design, development, and deliver legal training programs.
Compliance Responsibilities
Provide strategic compliance operational support in relation to:
• Lead the correct implementation of the new ABAC Framework published in Portugal.
• Collaborate with compliance teams across Gilead on policy, practices, and training.
• Ensure that the Spanish & Portuguese affiliate understand the why behind Gilead’s compliance requirements and
the areas of potential risk.
• Advice on points of interpretation for compliance requirements and required internal approval processes.
• Supports periodic compliance audits and ongoing monitoring of compliance of events and materials.
Knowledge and Skills
• Strong team-player and collaborates locally and across the regional and global Legal & Compliance function.

• Strong client service orientation and ability to recognize and respond quickly and pragmatically to urgent,

• is comfortable with operational compliance responsibilities including reviewing and approving meetings, events.
• Familiarity with AI tools and their application in legal and compliance processes is a plus.
Required Education & Experience
• Fully qualified lawyer, admitted to practice in Portugal.
• Strong knowledge of Portuguese law and regulatory environment.
• Fluency in Portuguese, Spanish, and English (advanced level).
• Based in Madrid or in Lisbon (in which case, willingness and ability to travel frequently to Madrid).
• AI knowledge and capabilities will be considered a plus.
• Extensive legal experience preferably with a combination of industry and law firm experience.
• Experience in pharmaceuticals, biotech or other highly regulated industries is a plus.
