Preferred Areas of Specialized Law: Direct Selling, Technology, Privacy, and Digital.
Position Overview: Highly skilled and experienced Attorney committed to provide comprehensive legal advice across various critical business areas, including technology, digital technologies, privacy, beauty devices, direct selling, and independent distributor agreements. This role will require an understanding of the legal and regulatory landscapes surrounding these industries and possess the ability to draft, review, and negotiate complex agreements while advising on legal risks and compliance matters.
This role is out of Provo, Utah.
Key Responsibilities:
Direct Selling Market and Distribution Models:
- Provide legal support and drafting of agreements and sign-up processes for direct selling operations, including compliance with direct selling laws, MLM regulations, and consumer protection requirements.
- Advise on contracts, and distributor agreements for direct selling and network marketing organizations.
- Support the drafting of policies governing sales representatives, commissions, and performance incentives.
Traditional Affiliate Agreements and Marketing:
- Draft, negotiate, and support affiliate and influencer/creator marketing agreements, ensuring compliance with advertising and social media regulations.
- Understand and advise on disclosure requirements for brand partnerships, influencer agreements, and affiliate marketing practices.
Policies, Procedures, and Risk Management:
- Support development, review, and update internal policies and procedures to ensure compliance with legal, regulatory, and business requirements.
- Counsel senior leadership and business units on risk management strategies and legal implications of business decisions.
Legal Support in Technology and Digital Innovation:
- Provide strategic legal counsel related to emerging digital technologies, including software, firmware, mobile apps, and digital platforms.
- Advise on data security, and licensing matters pertaining to new and innovative technologies.
- Ensure compliance with applicable regulations for digital products, including those related to e-commerce, digital marketing, and online services.
Privacy and Data Protection:
- Help create and implement policies, ensuring compliance with global privacy laws such as GDPR, CCPA, and other relevant data privacy regulations.
- Advise on best practices for data collection, usage, retention, and sharing, particularly regarding consumer and employee data.
- Oversee data breach protocols, incident response, and regulatory reporting.
Cross-Functional Collaboration:
- Work closely with product, marketing, and operations teams to address legal risks proactively in the development of new products and services.
- Provide training and guidance to internal teams on legal matters, policies, and compliance initiatives.
- Collaborate with external legal counsel and regulators, as necessary, to address legal issues.
- Train and educate internal teams on best practices and emerging legal trends in relevant fields.
Strategic Counsel:
- Stay current on changes in relevant laws and regulations and advise the company on how to adapt to new legal challenges.
Qualifications:
- J.D. from an accredited law school.
- Admission to the bar in at least one state, with the ability to practice in relevant jurisdictions including Utah.
- Minimum of 5+ years of experience in corporate or transactional law, with a preferred focus on technology, privacy, direct selling, and regulatory compliance.
- Understanding of the legal and regulatory frameworks governing digital technologies, data privacy laws, direct selling businesses, and health-related devices.
- Strong experience in drafting and negotiating complex contracts, including affiliate agreements, distributor agreements, and product licensing agreements.
- Proven ability to handle multiple complex legal matters across multiple areas of law and deliver clear, actionable advice to business leaders.
- Excellent communication, negotiation, and interpersonal skills.
- Understanding of consumer protection laws and direct selling regulatory frameworks.
- Understanding of global privacy laws (GDPR, CCPA, etc.).
- In-house counsel experience and an ability to thrive in a fast-paced and dynamic business environment.
Preferred Qualifications:
- Experience working with or within the beauty or health device industries.
