Job Summary:
The Real Estate Litigation Attorney serves as lead in-house litigation counsel for all real estate and construction related disputes concerning retail locations, distribution centers, gas stations, and other company locations.
Job Responsibilities:
- Provide strategic leadership over the Company’s real estate litigation function by overseeing construction and real estate risk controls and internal training initiatives, while partnering cross‑functionally to identify recurring risk trends and recommend contract revisions, process improvements, and dispute‑avoidance strategies to reduce litigation exposure across the portfolio and align risk allocation with business objectives.
- Lead strategy and resolution of landlord/tenant disputes (including notices of default, lease enforcement and interpretation issues, rent and CAM disputes, and repair and maintenance matters) and construction disputes (including defect claims, delay and scheduling disputes, payment disputes, mechanic’s lien matters, contractor performance issues, and warranty claims).
- Drive dispute avoidance by recommending contract revisions and process improvements, strengthening indemnity and insurance structures, enhancing dispute-resolution provisions, and developing playbooks and training programs for internal stakeholders.
- Direct and manage outside litigation counsel across multiple jurisdictions, including early case assessment, budgeting and accrual forecasting, pleadings, discovery and ESI strategy, motion practice, mediation, arbitration, and trial oversight; implement and manage litigation holds and internal discovery coordination as needed.
- Oversee other varieties of real estate litigation, including title disputes, easement and access matters, condemnation, bankruptcy-related real estate issues, environmental claims, and property damage claims.
- Draft and respond to demand letters, default notices, reservation of rights letters, settlement agreements, and related dispute correspondence.
- Coordinate with Risk Management and insurance carriers regarding claims strategy, coverage issues, and recovery efforts as appropriate.
Job Requirements:
- Bachelor’s degree and law degree from a top college or university
- Active license and good standing in at least one U.S. jurisdiction
- 10+ years’ experience at a top law firm handling complex commercial real estate litigation, including construction disputes and landlord/tenant matters with significant experience developing litigation strategy and independently managing high-value or high-risk matters
- Strong analytical, negotiation, and dispute-resolution skills, with the ability to provide clear, business-oriented advice to senior stakeholders
- Deep familiarity with commercial leases, construction contracts, development agreements, and related real estate documents, with experience in mediation, arbitration, and trial preparation
- Prior in-house experience supporting a national retail or commercial real estate portfolio with experience managing outside counsel and multi-jurisdictional litigation portfolios preferred
- Team player with sound judgment and the ability to work cross-functionally, balance litigation advocacy with proactive risk management and practical business solutions, and prioritize and handle multiple matters and projects with minimal supervision
- Flexible and willing to pitch in wherever new issues arise
This is a hybrid role. Tuesday through Thursday are in-office days at BJ's Club Support Center in Marlborough, MA and Monday and Friday are remote days.
In accordance with the Pay Transparency requirements, the following represents a good faith estimate of the compensation range for this position. At BJ’s Wholesale Club, we carefully consider a wide range of non-discriminatory factors when determining salary. Actual salaries will vary depending on factors including but not limited to location, education, experience, and qualifications. The pay range for this position is $194,000.00 - $276,750.00
