The Position

What should you do

Act as the China legal counsel for export control and sanctions (EC&S) and local EC&S Officer (LECO) to establish the Compliance governance and ensure the end-to-end implementation and continuous improvement of the EC&S Internal Management Compliance Program (IMCP) across all Roche Pharmaceuticals China affiliates and sites. His/her responsibilities include without limitation the following, as specified and updated from time to time by global compliance directive and process:

  • Implements or improves the company’s EC&S IMCP on site.
  • Maintains the local SOP related to EC&S compliance.
  • Defines the local EC&S training plan, assigns and delivers training, monitors the training performance.
  • Implements and maintains an appropriate local process to ensure the manual screening of prospective Business Partners against national and international sanctioned party lists.
  • Works closely with cross-function teams on product/material classification and transaction analysis, Business Partner screening, systems monitoring, information safeguards and etc. within the local organization and provide appropriate guidance.
  • Oversees the local usage of the EC&S contractual clauses.
  • Communicates with local management and escalates EC&S issues to the global team.

Act as a Legal counsel/business partner to:

  • Provide timely, solution-oriented legal advice to support commercial goals.
  • Review, draft, and negotiate a wide range of commercial contracts.
  • Participate in business meetings to identify potential legal risks and deliver legal trainings.
  • Manage dispute resolution and handle external investigations.

Provide any other Legal support to the company on legal compliance matters as assigned, such as develop and maintain legal compliance policies and internal processes, standards and templates; monitor changes in local and international laws/regulations that affect the industry and company; implement the global legal compliance directive, process and programs; handle any other legal matters or ad-hoc assignments as directed by the line manager and/or the Legal and Compliance head.

Who you are

Education

  • Minimum Requirement: bachelor degree in law from either a fine domestic or an overseas university.
  • Preferred: LL.M. or JD with a focus on International Trade Law or Corporate Compliance is highly desirable.

Professional knowledge and Experience

  • Admission to the bar in China.
  • General Experience: Minimum of 5 years of professional experience in legal, preferred combined with experiences in trade compliance or regulatory affairs within a MNC.
  • Regulatory Expertise: Deep understanding of the China and international export control and sanctions laws and regulations.
  • Industry Specifics: experience in the Pharmaceutical, Biotechnology, or Life Sciences sector is preferred.
  • Proven Track Record: Demonstrated experience in managing Export Control programs and handling complex licensing requirements is strongly preferred.

Language & Communication

  • English: Professional working proficiency (written and oral) for regular interacting with international stakeholders.
  • Mandarin: Native fluency.
