Job Title: Legal Counsel (12 months FTC)

Location: KL, Malaysia (Hybrid, 50% working time at the office)

Employment type: Full-time

The job

To support the legal operations team in mitigating risks across a range of areas with particular emphasis on software piracy claims, day-to-day support to AVEVA’s global license compliance audit team (ALC) as well as some general litigation support on global commercial disputes from time to time. 

Key Responsibilities

  • An interesting and varied role to support the Global Legal Operations team at AVEVA 

  • Reports to Legal Director, Commercial Disputes & Software Piracy, Global Legal Operations (based in Australia)

  • Provide software piracy and ALC support to the Legal Director, Commercial Disputes & Software Piracy, Global Legal Ops (based in APAC region) 

  • Support will include:

    • assisting the Legal Director with escalations from the ALC team and Software Piracy Investigations team including litigation, enforcement actions, settlement and resolution support on complex matters 

    • providing day-to-day support to the Software Piracy investigations team on identifying the most legally cogent and cost-effective cases for escalation to the Legal Director 

    • liaising with global stakeholders to obtain further information and instructions, identifying preliminary key risks and issues, and undertaking risk assessment (and any early mitigation strategies) for review by Legal Director  

    • assisting the Legal Director with drafting instructions to external counsel, preparing internal advice on risks, exposure and options for risk mitigation, and negotiating and drafting of settlements 

    • providing support with “business as usual” legal support requests from the ALC team to: 

      • conduct contract reviews of audit rights and remedies (particularly where there are legacy agreements)  

      • obtain engagement from customers with ALC team license compliance audit including preparing NDAs, legal notices of breach, “ghost-writing” of comms to sensitive customer accounts  

      • assist ALC and Sales in settlement and resolution support on non-complex matters, preparing commercial terms as part of settlement under a holistic resolution

      • assisting the Legal Director with monthly and quarterly internal litigation reporting of risks and/or reporting of KPI metrics (as they relate to software piracy matters) to the VP of Global Legal Operations and the ELT 

  • An opportunity to assist the Legal Director with general litigation support other global commercial disputes from time to time

Knowledge, Skills & Experience Required 

  • Minimum 5–8 years’ post-qualification experience as a qualified lawyer/attorney gained in a top-tier law firm and/or multinational in-house environment.

  • Experience with global IT services company providing software licensing and maintenance services preferred

  • Experience handling commercial disputes, copyright infringement, intellectual property enforcement, software licensing disputes, or software piracy matters

  • Good command of spoken and written English. Knowledge of another Asian language would be a significant advantage

  • Familiar with business culture and ethics in Asia and experienced in international business horizon

  • Strong influencing and negotiation skills at all levels  

  • Ability to build rapport and robust relationships  

  • Strong team player 

  • Willingness to explore and upskills in the other areas mentioned above with any prior experience in any of these fields preferrable 

  • Previous in-House experience preferrable
