Job Description Summary:
This position provides legal representation of and support to administrators, faculty and staff of The Texas A&M University System on behalf of the Health and Business Affairs section.
Responsibilities:
- Provides legal advice and counsel to System administrators, as well as, faculty and staff on a wide range of commercial/business transactions and research matters. This includes, but is not limited to, reviewing and drafting all types of commercial and business agreements for products and services, from both an acquisition and provider perspective, as well as a wide range of research related agreements, including, but not limited to, software/IT agreements, benefits administration agreements, services agreements, affiliation agreements, memorandum of understanding, data use/transfer agreements, clinical research agreements, and non-disclosure agreements.
- Interprets federal and state laws and regulations and System policies, regulations and rules.
- Drafts and advises on policies and procedures, proposed legislation, requests for Attorney General Opinions, open records decisions and related amicus briefs, and internal legal memorandums and opinions.
- Participates in Office of General Counsel matters, including practice area assignments, workshops, briefing papers, presentations and trainings, special initiatives, etc.
- Provides legal advice and counsel to System administrators, faculty and staff in areas of institutional compliance, with an emphasis on healthcare, privacy and cybersecurity. This includes, but is not limited to, providing advice and counsel regarding federal, state, local and other compliance requirements which involves, but is not limited to, patient confidentiality, HIPAA, telehealth, FERPA, human subject research regulations, privacy and cybersecurity.
- Drafts notices and consents and participates in and responds to internal and government led investigations regarding compliance and enforcement matters.
- Interprets and provides counsel and guidance on new and emerging legal and regulatory issues at the federal and state levels and assists in the review, interpretation and drafting of System policies, regulations and guidance.
- Assists in drafting and preparing responses to proposed legislation and counseling on legislation passed into law.
- Develops well-researched internal legal memorandums and opinions.
- Other duties as assigned.
Education and Experience:
- Bachelor of Law (LL.B.) or Juris Doctor (J.D.) degree.
- At least one year of related legal experience.
Knowledge, Skills and Abilities:
- Knowledge of word processing and spreadsheet applications.
- Knowledge of subject matter in assigned practice area(s).
- Ability to multitask and work cooperatively with others.
- Strong verbal and written communication skills.
- Ability to manage a broad range of complex legal issues for multiple clients throughout the state.
Travel required.
Registrations, Certifications, and Licenses:
- Member of the State Bar of Texas in good standing or will obtain a Texas law license through reciprocity within 12 months of hire date.
Preferred Qualifications:
- State Agency experience.
