SENIOR COUNSEL (Litigation & Claims)

Descriptive Summary

The Senior Counsel (Litigation & Claims) is responsible for managing and making strategic decisions regarding claims and litigation at the company. In this role you will work closely with outside counsel, insurers, and company decision makers. The position also will require collaboration with company employees at all levels of the business. This is an excellent opportunity for an attorney with significant construction litigation experience to serve as the in-house counsel responsible for managing a large docket and providing legal counsel to employees enterprise wide.

Essential Functions

  • Manage construction defect/general liability matters nationwide in a cost-effective manner via outside counsel or directly.

    • Including with respect to overall strategy, discovery, mediation, arbitration, litigation, and settlement.

  • Manage insurance claims, including tendering to appropriate policies.

  • Draft legal documents, including correspondence with opposing counsel, legal holds, pleadings, motions, and briefs, and perform related research as required.

  • Work with employees across the company to collect and produce discovery materials and responses.

  • Advise, communicate, and confer with General Counsel rendering clear legal opinions and advice.

  • Collaborate with internal business clients, with a customer service-oriented approach.

  • Understand the company’s key business processes (e.g., procurement, warehousing, manufacturing, field installation, and homeowner design services), materials, third-party relationships, and other issues relevant to managing claims/disputes.

  • Leverage technology (experience with Thompson Reuter’s Legal Tracker is preferred).

  • Provide legal guidance and support as needed for:

    • Workers’ comp matters

    • Collections

  • Periodic travel is required.

Education & Experience

  • Juris Doctor from an accredited law school.

  • Current membership in good standing of state bar, California preferred.

  • Five to ten years of construction litigation experience, preferably representing builders, contractors, and/or subcontractors.

  • Significant experience with pleadings and motions practice, taking and defending depositions of experts and percipient witnesses, making court appearances, complete file handling, and preparing for trial and arbitration.

  • Experience litigating additional insured and indemnity claims against subcontractors and suppliers.

  • Knowledge of “Right to Repair” laws in various states, including California’s Right to Repair Act (CC 896 et seq).

  • Strong research, writing, analytical, presentation, advocacy, negotiation, and interpersonal skills.

  • Skilled in drafting pleadings, motions, discovery, mediation statements, and status reports.

  • Knowledgeable in document management databases and court electronic filing systems.

  • Experience managing a large caseload.

  • Leadership and confidence while also being able to participate effectively and constructively as a member of a team.

  • Ability to exercise sound judgment and working independently and efficiently under time pressures and deadlines in a fast-paced, demanding environment.
