Job Description:

At Ferrovial Digital Infrastructure (FDI), we specialize in the development of data center assets, from powered-land search and acquisition to DC design, construction, operation & maintenance, and we are always looking or the most efficient and sustainable solutions.

FDI has acquired a land plot for the development of a new hyperscale Data Center and we are seeking an experienced Legal Counsel to lead all legal aspects of the project.

The role reports to the Project Director and works closely with the project leadership, engineering, procurement, finance, real estate, compliance, and operations teams.

The ideal candidate will have a strong background in managing legal aspects of large-scale construction projects and, in particular, in negotiating complex construction, supply and commercial contracts with focus on allocation of risk, continuity, and remedies across large-scale project phases.  

We are looking for an Legal Counsel to lead and manage all legal aspects of a data center project in Madrid[, within the data center development team belonging to Ferrovial Digital Infrastructures]. The person will be responsible for providing pragmatic commercial and regulatory advice, drafting and negotiating contracts, managing third-party legal advisors, overseeing permitting and land use matters and ensuring compliance with applicable laws and internal policies of Ferrovial across project lifecycle phases from construction to commissioning and operations.

This role requires a person that is comfortable working in fast-moving, multidisciplinary project environments with competing priorities and tight deadlines and is committed to high standards of corporate governance, regulatory compliance, and professional integrity.

 Requirements:

  • Law degree (qualified practice law in Spain). Additional specific studies or postgraduate studies in construction law and/or energy law will be positively valued. 
  • Minimum demonstrable experience of 3-6 years of legal experience, preferably in in-house roles or at law firms advising on large-scale infrastructure, energy or data centre projects.
  • Demonstrable track record in projects involving power procurement, grid connection, EPC contracts, or large-scale construction.
  • Proven experience drafting and negotiating EPC, O&M, supply, and utility agreements, and managing claims and variations.
  • Practical knowledge of permitting, land use, environmental permitting and energy sector regulation in the relevant jurisdiction.
  • Fluency in English.
  • Ability to translate complex legal issues into clear commercial options and pragmatical recommendations.
  • Ability to understand technical project documents, schedules and interfaces to advise on legal implications.
  • Analytical, detail-oriented, effective communication skills and ability to build trust and persuade internal and external stakeholders to achieve commercially sound outcomes.
  • Leadership and organisational skills and ability to manage pressure during critical project milestones.
  • The following would be an asset:
    • Previous experience with data protection, telecoms, and environmental permitting.
    • Experience in supporting financings.

  •  Key Responsibilities:

  • Prepare, review, and negotiate EPC, O&M, supply, grid connection, power purchase, lease, license, confidentiality, and service agreements.
  • Legal management of corporate and compliance matters of the project company.
  • Lead permitting strategy, manage regulatory filings, coordinate with local, regional, and national authorities, and ensure compliance with energy, environmental, data protection, and telecoms regulations.
  • Manage and coordinate dispute resolution, claims under construction contracts, and liaison with external counsel.
  • Identify legal risks, implement mitigation measures, develop and maintain compliance programs.
  • Support in the processing of easements, rights of way, leases, and title due diligence.
  • Ensure compliance with local regulations and international standards.
  • Reporting to the Project Director and other legal teams in Ferrovial on the status of the legal aspects of the project and provide regular risk/status reports to senior management.
  • Coordinate with the rest of the project development team in the Digital Infrastructure division, ensuring alignment with strategic objectives.
  • Provide advice on corporate governance, procurement processes, commercial arrangements, and stakeholder communications.
  • Foster a positive and collaborative working environment.
  • Supervise external law firms and vendors; manage legal budgets and invoicing.
  • Collaborate to ensure that all projects are delivered on time, within scope and budget.
  • Maintain project legal files, license registers and contractual trackers.
